INFORMATION REGARDING THE PROCESSING OF PERSONAL DATA

Hubilia S.R.L (hereinafter also “Hubilia" or the “Company") wishes to provide, pursuant to and for the purposes of articles 13 and 14 of Regulation (EU) 2016/679, relating to the protection of individuals with regard to the processing of personal data (hereinafter “GDPR"), some information about the purposes, methods and scope of communication and dissemination of personal data provided by adult candidates through registration in the reserved area of ​​the Hubilia website (hereinafter the “Site"), the websites of any third party companies and social networks, or by e-mail or during an interview at one of the our offices.

Limited to the registration credentials for the reserved area (e-mail address and password provided by you during registration), these will be made available to the other companies belonging to the group (if any), which act as independent data controllers, to allow you to speed up the registration procedure to the restricted areas of the respective websites by entering the Hubilia registration credentials.

PURPOSE OF PROCESSING FOR REGISTRATION IN THE RESERVED AREA HUBILIA, SEARCH AND SELECTION OF CANDIDATES, AND LEGAL BASES

1) Your data is collected in the following ways:

– Upon your registration in the Hubilia reserved area;

– by email;

– at our offices;

– through third party websites or social networks.

2) Your data is processed for registration in the Hubilia reserved area to be carried out both in the case of an application in response to a specific advertisement published on the Site and in the case of a voluntary application through the Site.

3) The legal basis applicable to the processing of your personal data for the purposes referred to in point 2 is the execution of a contract pursuant to art. 6 paragraph 1 lett. b) of the GDPR.

4) Your data are processed both in the case of an application in response to a specific announcement and in the case of a voluntary application for the pursuit of the purpose of searching and selecting candidates, in particular:

  1. for placement at Hubilia or companies of the group
  2. for direct placement at our third-party client company
  3. for the creation of courses or measures of active labor policies or in the context of collaborations and / or partnerships with public and private market operators.

Your data is also processed to send you service communications using traditional or automated contact methods, including communications relating to training initiatives strictly linked to a specific position, financed by our client company or by inter-professional funds.

In the event of an application in response to a specific announcement, your data may also be processed for future research and selection of personnel, if you do not object to such processing at the time of providing the data or subsequently. If you object to this processing, your data is processed exclusively within the context of the specific selection for which you have applied.

5) The legal basis applicable to the processing of your personal data for the purposes referred to in point 1.4, is the execution of pre-contractual measures adopted at your request pursuant to art. 6 paragraph 1 lett. b) of the GDPR.

6) Your data may also be processed to ascertain, exercise or defend our right in court.

7) The legal basis applicable to the processing of your personal data for the purposes referred to in point 1.6. it is our legitimate interest pursuant to art. 6 paragraph 1 lett. f) of the GDPR. The legal basis applicable to the processing of special categories of personal data concerning you for the same purposes is the ascertainment, exercise or defense of a right in court pursuant to art. 9 paragraph 2 lett. f) of the GDPR.

FURTHER PURPOSES OF THE PROCESSING AND LEGAL BASES

Your data may also be processed, if you give your consent, for the following additional purposes:

sending information and promotional communications relating to the services offered by Hubilia (in particular, training initiatives, career development, coaching), or the completion of studies and statistical and / or market research relating to services at work, both with traditional contact (paper mail, calls via operator) and with automated contact methods (e-mail, sms, mms, instant messaging systems);

sending information and promotional communications relating to the services offered by the other companies of the Hubilia Group – located in the EU and non-EU – (in particular, training initiatives, career development, coaching, support for relocation, research and selection of personnel and executive search ), or the carrying out of studies and statistical and / or market research relating to services at work, both with fashion traditional contact methods (paper mail, calls via operator) and with automated contact methods (e-mail, sms, mms, instant messaging systems).

The legal basis applicable to the processing of personal data concerning you for the purposes referred to in point 2.1. is your consent pursuant to art. 6 paragraph 1 lett. a) of the GDPR.

It is understood that consent to the processing of data for these purposes is purely optional; therefore, in the event of a refusal to process for the aforementioned purpose, your data will be processed only for the purposes indicated in the previous point 1.

CATEGORIES OF DATA PROCESSED, SOURCE OF DATA AND PROCESSING OF SPECIAL CATEGORIES OF DATA

Hubilia, by way of example and not limited to, will collect the following categories of common personal data: name, surname, password, date of birth, residence, e-mail address and telephone contacts, educational qualification, work experience and any additional data from you inserted in the curriculum vitae and / or provided during the interview at one of the offices.

Hubilia will collect the aforementioned data from you and / or from websites managed by third parties or social networks through which Hubilia publishes ads (on behalf of client companies or on its own) or through which it can consult the profiles of candidates.

If you respond to an advertisement or apply voluntarily, you will be given the opportunity to declare your possible belonging to a protected category in the data collection forms on the Site or during a telephone interview or at one of the branches. This information is suitable for revealing the state of health and falls within the particular categories of data referred to in Article 9, paragraph 1 of the GDPR and will be treated in accordance with current regulations on the subject (including Legislative Decree No. 276 / 2003).

The legal basis applicable to the processing of particular categories of personal data concerning you for the purposes described in point 1.2 is your explicit consent pursuant to art. 9 paragraph 2 lett. a) of the GDPR.

In the event that he does not give his consent, it will not be possible to process the data relating to his belonging to a protected category.

Instead, please do not indicate in your curriculum vitae particular categories of data (personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data intended to identify uniquely a natural person, data relating to the health or sexual life or sexual orientation of the person).

DATA RETENTION PERIOD

In the case of data processing for the purposes of registration in the Hubilia reserved area and of research and selection referred to in paragraph 1 in relation to a voluntary application, the data are entered in the company database and kept for 30 months from their insertion, or from your last interaction with the Site (access, updating of data, or uploading your curriculum vitae) or with the agencies except for your manifestation of will to a further retention period of your data that you will be asked to express before the expiry of the aforementioned term.

In the case of data processing for the purposes of registration in the Hubilia reserved area and search and selection referred to in paragraph 1 in response to a specific announcement, if you object to the storage of your data for future selections, the data are entered in the company database and kept for the entire duration of the selection and, in the event that the same has a negative outcome, until the closing of the same.

In the case of data processing for the purposes related to the ascertainment, exercise or defense of a right in court referred to in paragraph 1, the data are entered in a historical archive and kept for the entire duration of the dispute, up to the exhaustion of the terms of enforceability of the appeals.

In the case of data processing for the additional purposes referred to in point 2.1, the data are entered in the company database and kept for the duration indicated in point 4.1 or until you revoke your consent.

Once the retention terms indicated above have elapsed, the data are destroyed or made anonymous.

NATURE OF DATA CONFERENCE AND CONSEQUENCES OF REFUSAL

The provision of data highlighted with an asterisk in the registration form to the Hubilia reserved area is necessary to allow the company to complete its registration referred to in point 1 above; therefore, any refusal to provide the requested data will prevent Hubilia from completing its registration in the reserved area.

The provision of data for the purposes referred to in point 2 above is optional. Any refusal to provide data or failure to provide consent will have no consequence on your registration with Hubilia and will not prevent the company from carrying out research and selection activities.

METHOD OF TREATMENT

Data processing is based on principles of correctness, lawfulness and transparency and data minimization (privacy by design); can be carried out both manually and through automated methods designed to store, process and transmit them and will take place through appropriate technical and organizational measures, as far as reason and to the state of the art, to guarantee, among other things, security, confidentiality, " integrity, availability and resilience of systems and services, avoiding the risk of loss, destruction, unauthorized access or disclosure or, in any case, illicit use, as well as through reasonable measures to promptly delete or rectify inaccurate data with respect to the purposes for which are treated.

RECIPIENTS OF THE DATA

Your data may be processed exclusively by employees of the company departments authorized to process them as they are appointed to pursue the aforementioned purposes. These employees have received adequate operating instructions in this regard.

Your personal data may be communicated by Hubilia, for the pursuit of the purposes referred to in point 1 above, to the following subjects:

Client companies or entities;

Ministry of Labour;

Public Bodies in the context of the creation of courses or measures of active labor policies;

Other market operators in the case of partnerships;

Legal advisors;

Training institutions

Group companies in Italy or abroad.

Your personal data may be communicated by the IM, for the pursuit of the purposes referred to in point 3 above, to the Group Companies, in Italy or abroad.

Your personal data may also be processed by external parties, expressly appointed as data processors, who provide Hubilia with:

Site management and maintenance services;

Candidate database management and maintenance services

Archiving services;

Communications mailing services;

Market research services.

The personal data provided by the candidates will not be disseminated.

TRANSFER OF DATA OUTSIDE THE EU

Your data may be transferred abroad to countries outside the European Union, and in particular in:

RIGHTS OF THE INTERESTED PARTY

The interested parties are entitled to the rights referred to in Articles. 15 to 22 of the GDPR, where applicable.

In particular, interested parties may ask the owners to access the data, their cancellation, the correction of inaccurate data, the integration of incomplete data, as well as the limitation of processing in the cases provided for by art. 18 of the GDPR.

Interested parties have the right to object, at any time, in whole or in part, to the processing of data necessary for the legitimate pursuit of the owners’ interests.

Furthermore, in the event that the conditions for exercising the right to portability pursuant to art. 20 of the GDPR, have the right to receive the data provided to the owners in a structured format, commonly used and readable by an automatic device, as well as, if technically feasible, to transmit them to another owner without impediments.

Interested parties have the right to lodge a complaint with the competent supervisory authority (in particular in the Member State in which they usually reside or work or in the State in which the alleged violation has occurred).

WITHDRAWAL OF CONSENT

Interested parties have the right to withdraw the consent given at any time through their account on Hubilia reserved area or by sending an e-mail to privacy@hubilia.com.

The withdrawal of consent does not affect the lawfulness of the processing based on the consent you gave prior to the withdrawal.
